What to Consider Before Making a QCAT Application

You can apply to QCAT requesting the tribunal make certain decisions, however, there are some things to consider before moving forward in that direction.

Things To Consider

  • The Department of Justice and Attorney-General’s Dispute Resolution Centre offers a free mediation service that you may want to consider.
  • There are often costs involved when making an application. It’s important that you have all the information before moving forward.
  • Time limits may apply for making applications. You can check your matter type for more information.
  • You must identify the correct parties to the application and the correct legal name must be used for the parties. Please note that QCAT staff cannot give you advice about who the correct parties are.
  • You need to know the location of the other party so you can provide them with a copy of the application.
  • Make sure you have evidence and/or witnesses who are able to prove your case
  • It’s important to note that in most matters you will need to represent yourself.
  • While QCAT staff cannot offer you any legal advice. You can seek independent legal advice.
  • You can expect that it may be a a stressful process
  • You can look at previous decisions and orders in your type of case to understand what might happen.
  • Make sure you are aware of how long the process might take.
