Service Rules For Document Service

Depending on the type of document you need served, there are different requirements that you need to abide by regarding when you must serve the documents on the other party. The court will always give ample time for an individual to serve documents, however, it is your responsibility to organize service with enough time for a document server or bailiff to deliver the documents, which can take up to 2 weeks or more for regional and remote areas.

QCAT Documents

You have 90 days from the time that the document is stamped by the court

Magistrates Court Documents

You have 12 months from the time that the document is stamped by the court

Enforcement Hearing Summons

You must serve the document at least 14 days before the day set for the enforcement hearing.

Family Law Documents

You must serve the documents at least 28 days before the day set for the hearing

Don’t Run Out of Time

Again, it is up to the individual to make sure documents are delivered to a process server or bailiff in enough time for service.
